The Client (hirer)
As the person responsible for hiring an item from Nepean Wishing Wells, we advise you to read our terms and conditions of hire (TCOH). When placing an order, we will provide you with your own copy of these terms. We will require you to electronically agree to these conditions upon placing a booking request with us and you will be asked to sign document when collecting your item(s). You as the hirer will be held responsible for all items during the hiring period at all times until returned to Nepean Wishing Wells.
Agreement to Conduct Appeal for Starlight Children's Foundation Australia
Charitable Fundraising Act 1991, Charitable Fundraising Regulations 2003 and Lotteries and Art Unions Act 1901. Starlight authorises the persons named below to conduct an appeal in support of Starlight on the date(s) and at the place(s) set out here under subject to the terms and conditions outlined in the Fundraising Agreement. Nepean Wishing Wells has authorisation granted from: 10/02/2010 to 14/01/2011. Registration / Sanction Number: 1002. Event Details: % of sales throughout the year will be donated towards the 2010 Christmas Appeal. Event Venue: Online. Date of Event: 5/02/2010 to 31/12/2010 Nature of Donation: % of sales. This sanction is granted subject to strict compliance with the provisions of the Charitable Fundraising Act 1991, Charitable Fundraising Regulations 2003 and Lotteries and Art Unions Act 1901.
The Provider
Trading as ‘Nepean Wishing Wells’. ABN: 68 286 237 347. Active registered Company with Australian Taxation Office since the Twentieth Day of the second month, two thousand and nine. Nepean Wishing Wells is a registered business name in accordance with the Business Names Act 2002. The business name being lodged with the New South Wales Department of Fair Trading, BN98476870. As the provider, we will issue you with an itemised Tax Invoice for all payments made to Nepean Wishing Wells for hired items. You can choose to have this Tax Invoice mailed to your place of residence or emailed to you.
Bookings & Cancellations
When making a booking we will hold the item(s) for a period of seven (7) days. The booking fee must be paid within seven (7) days to secure your item for the hire period. When your booking fee is paid, your booking fee will become the hiring fee. The remainder of the fees, being the security bond must be paid seven (7) days prior to the collection of the item(s).
If any cancellations are made within fourteen (14) days of the booking date, the total booking/hire fee will be forfeited. Outside of these fourteen (14) days, an administration fee of $20.00 will be held on cancellation, with the remainder being refunded within seven (7) days. For any late bookings within seven (7) days of the hire date, a 20% surcharge will apply.
Hire Periods & Delayed Returns
The hire period for either a Wishing Well or Treasure Chest is a total of four (4) days. Item(s) will be ready for collection from Thursdays. For example, if you collect your hired item(s) on a Thursday, you will be required to return it on Sunday and so forth. Alternative arrangements can be made with Nepean Wishing Wells upon special request. If this occurs, then both parties will agree in writing when signing the TCOH document.
If an item(s) is returned after the mutually agreed date, the Security Bond will be forfeited to Nepean Wishing Wells.
Delivery & Pickup (if utalising our delivery service)
Nepean Wishing Wells offers a delivery service for Wishing Wells and Treasure Chests within a specified area. To be entitled to delivery you must reside within the locations shown on the map, which is available to be viewed on the ‘Delivery Options’ page of www.nepeanwishingwells.com.au. At this point in time, Nepean Wishing Wells cannot deliver Wishing Wells or Treasure Chests direct to a non-hirer's address (for example, Wedding Reception venue, Community Hall etc etc) unless the hirer is at the said location to personally collect the item(s). To discuss this further, please feel free to contact us. The reason for this is because the hirer is responsible for the items at all times and Wedding Reception Venues WILL NOT take ownership or responsibility for item(s) left at their venues. Nepean Wishing Wells also needs to meet with the hirer to hand over any keys for the padlock to the Well or Chest and to sign confirmation of delivery.
Nepean Wishing Wells will liaise with the hirer to organise relevant times to deliver and pick up items. All areas outside of the map incur further charges, which are quoted by Nepean Wishing Wells. Email sales@nepeanwishingwells.com.au for enquires. Nepean Wishing Wells will apply charges to deliveries where paid street parking is used.
Damages & Personal Liability
All item(s) are hired in a good order and condition. This includes all moving parts, padlocks, key, items used for decoration and cleanliness of the item(s). The hirer is responsible for the item(s) at all times until returned to Nepean Wishing Wells. Damage to any item by the hirer or their guests is the hirers’ responsibility. If any item(s) is not returned in the original order and condition or if any item(s) are lost, the hirers’ Security Bond will be forfeited to Nepean Wishing Wells.
Nepean Wishing Wells will not be held responsible for any injuries or damages caused by our item(s) during the hiring period.
Decoration of Well or Treasure Chest
You may choose to decorate the well or treasure chest yourself or have a nominated florist decorate it for you. No staples, screws, sticky tape or other implements intended to secure items onto the well or chest may be used. The hirer can use Bluetak to secure items onto the well or chest, however, this must be cleaned off prior to returning it to Nepean Wishing Wells. When cleaning items, be sure not to use a cleaning agent, likely to cause damage. All decorations supplied by Nepean Wishing Wells must be returned in the same order and condition they were hired in.
Obtaining a Quote From Nepean Wishing Wells
Nepean Wishing Wells can provide you with a detailed quote of your hired item(s) with any additional fee's such as Security Bond, accessories and delivery/pick up charges. Quotes can be obtained by submitting a booking request online from our 'How to Hire' page. You are under no obligation whatsoever to book with Nepean Wishing Wells if you choose to have a quote provided to you. All quotes will be emailed direct to the hirer and are valid for a seven (7) day period. If you choose to then proceed with your booking, Nepean Wishing Wells will then send you a Tax Invoice on how to process any payments.
Payment Options & Return of Security Bonds
Nepean Wishing Wells accepts payments for hire and deposit VIA Cash, Direct Deposit (Credit Union), PayPal, Credit Card VIA PayPal (surcharge of 2.4% applies) and Australian Post Money Order.
When returning Security Bonds, Nepean Wishing Wells will return the funds via the following means:
- Paid by Cash - Returned VIA Cash/Bank account (allow seven (7) days to clear),
- Paid by PayPal - Returned VIA Direct Deposit (allow seven (7) days to clear),
- Paid by Direct Deposit – Returned VIA Direct Deposit (allow seven (7) days to clear),
- Paid by Australian Money Order - Returned VIA Direct Deposit (allow seven (7) days to clear).
Summary of Payments and Charges
Booking fee: Paid within 7 days to confirm your booking. Booking fee becomes your hire fee.
Late Bookings: A 20% surcharge applies to all bookings received within seven (7) days of the hire date.
Security Bond : Paid in full 7 days prior to the function date. Returned at the end of booking period (see above TCOH for details).
Cancellation Charge (2 weeks prior to booking date): $20.00 admin fee applies to any cancellation that is made 14 days or earlier to function date. Balance of booking fee returned to hirer (see above TCOH for details).
Cancellation Charge (Within 2 weeks of booking date): Full booking/hiring fee is forfeited to Nepean Wishing Wells. If bond has been paid, bond is returned to hirer within 7 days (see above TCOH for details)
